Object

These terms and conditions apply between: The company Badam TS, (EIRL TSEDENDORJ Badam Ochir), whose registered office is located 32 rue Jean Mermoz, 75008 PARIS, registered at the Directory of Professionals of the Chambre des Métiers et de l’Artisanat under the SIRET number 527.895.213.00025. Hereinafter referred to as "Badam TS" And Any person visiting and / or making a purchase via the Internet www.badamts.fr site. Hereinafter referred to as "user" These conditions aim to define the terms of sale between Badam TS and the user, the order to payment and delivery. They cover all the necessary steps for placing the order and tracking of this order between the contracting parties. The order implies the irrevocable acceptance of these general conditions of sale. These terms and conditions may be subject to change, the conditions applicable are those effective on www.badamts.com at the date of placing the order by the user. The user declares to have the capacity to enter into this contract that is to say, of legal age and not under guardianship.

Products

Products offered for sale by Badam TS are those appearing on the site www.badamts.com on the day the user is visiting the website. Products are offered for sale within the limits of available stocks. The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions were to occur in this presentation, the responsibility of Badam TS could not be committed. The photographs and texts illustrating the products are indicative only and are not included in the contract.

Prices

Prices are shown in euros (€) (or in US dollar upon user choice in the English version, but the price in US dollar is only for reference and the transaction is done in Euro currency) and include all taxes (20% French VAT) (VAT is not applicable for intracommunity professionnals with VAT identification number) and exclude shipping costs which are borne by the user unless otherwise specified or particular conditions. Badam TS has the right to change prices at any time. The products will be billed based on rates in effect at the time of registration of the order.

Order

All orders constitute explicit and irrevocable acceptance of the prices and descriptions of products available for sale. The user acknowledges having read and irrevocably accepted these Terms and conditions before placing an order. Validating the order implies acceptance of these terms and conditions. To allow the user to return to his command before final confirmation, Badam TS created validation and acceptance screens. The order will be permanently registered at the last validation of the payment screen of the order (credit card, bank transfer or check). As of last click of acceptance, the order is considered final. It is planned, after the registration of the order, sending an e-mail to the user. This e-mail confirms that Badam TS took the customer order into account and that the product is available.

Payment

Payment is made either online by credit card or by bank transfer or by check (issued by a French Bank) or by Pay-Pal system. Product invoice will be included in the package containing the ordered product. For the "gift" orders, upon request by the user, invoice will be sent directly to the billing address. - Online payment by credit card: The cards accepted are Visa and Mastercard credit card. The account is debited for the amount of products ordered. - Payment by check: If paying by check, a bank based in France must issue the check. Check payable at the name of "Badam TS" must be received within 10 business days after confirmation of the order at the following address: Badam TS, 32 rue Jean Mermoz, 75008 PARIS. The order is enabled only after cashing the check. - Payment by bank transfer: a RIB is made available to the client, the order is then released upon receipt of bank transfer.

Fight against fraud

Credit card information in connection with the order is subject to automated processing. All credit card payment is made through a site secured by BRED Banque Populaire. Badam TS will be free to check the personal data provided by the client and to adopt the measures deemed necessary (request for evidence or cancellation of the order) so that the person whose bank account is debited is actually the one who placed the order to avoid fraudulent use of credit card numbers. Deliveries to PO Box, cyber cafe or other indirect address will be systematically denied, as they cannot be verified as valid. Accordance with the law Informatique et Liberté of 6 January 1978, the user has at any time a right of access, rectification and opposition to all personal data by writing and providing proof of identity to Fia-Net – Service Informatique et Libertés, 22 rue Drouot 75009 Paris.

Secure payment

To ensure the security of payments, www.badamts.com site uses secure payment service of BRED Banque Populaire: CYBERPLUS; This service integrates safety standard: PCI-DSS (CB approval, VISA and MASTERCARD). The confidential data (card number 16 digits, expiration date and cryptogram) are directly transmitted in an encrypted format to the CYBERPLUS server without passing on physical media of Badam TS server. After confirming the order, the payment request is routed in real-time to the online payment protected handler of BRED Banque Populaire. It sends a request for authorization to the credit card network. The online payment management issues an electronic certificat. 

Shipping, Payment and Delivery

Shipping within 5 business then delivery within 24-48 hours through Colissimo Express, depending on the terms and conditions of the Post Office (managing Colissimo), unless otherwise specified (in the case of products whose delivery requires a higher number of business days or if the product is unavailable). Except in cases of force majeure, the delivery times will be applicable only within the limits of available stocks. The responsibility of Badam TS can not be held liable for late delivery, for any reason whatsoever, therefore no claim can be claimed by the user to Badam TS. Badam TS reserves the choice of carrier and guarantees the delivery of products. The user is responsible for checking the condition of the packaging and the conformity of the product delivered and to issue any appropriate reserve on the delivery of the carrier. In case of payment by check, the order will be processed once the check is cashed. Deliveries are made in France and abroad by Colissimo services with express parcel followed through tracking number and delivery of parcels against signature. Shipping costs are offered for delivery in France over 100 € purchase and for delivery abroad over 200€ except during sale periods for which an even better offer may be proposed.

Products information and recommendations for use

Guidance, practical advice on products manufactured and distributed by Badam TS, provided on the Site or by e-mail in response to a question electronically sent by a user, are indicative.

Returns and Exchanges

The user shall have 10 working days to exchange or return an item and be reimbursed (from the date of receipt of the order). After this period, the delivered products are deemed compliant and accepted by the user, and Badam TS has the right to refuse the exchange, credit or refund. The returned item must not have been used, being in its original packaging for returns by post accompanied by a copy of the packing slip and reason for return.

Return by post: The user has the option to return an item to the following address: Badam TS - 32 rue Jean Mermoz, 75008 PARIS. In case of an order cancellation and refund the return shipping costs have to be borne by the user. The item will be reimbursed either by check, bank transfer or credit card, depending on the payment method when ordering. The refund will be made within a maximum of 20 working days.

In case of an exchange, the shipping costs of the new exchanged product sent by Badam TS are borne by Badam TS (for past purchases on www.badamts.fr site), in the limit of one exchange. In the case of unavailable stock for exchange incumbent to Badam TS, a voucher will compensate the customer.

For obvious impossibility to sell to another client a product specifically tailored, such tailored product can not be returned or exchanged except for quality problem.

Protection of personal data

Nominative information: The collection of personal information obtained under the internet shopping process is necessary, this information is necessary for the processing and delivery of orders and for preparing invoices. This information is strictly confidential and is intended only for Badam TS. Any user who has a personal website and wishes to place, for personal use, on his website a direct link to the homepage of Badam TS must request permission from the Badam TS company. It will not be in this case an implicit affiliation agreement. However any hypertext link to the Badam TS website using technique such as the technique of framing, deep linking, in-line linking or any other technical deep link, is in any case prohibited. Responsibility

Duration

These conditions apply throughout the duration of online services offered by Badam TS.

Applicable Law - Disputes

These general sales conditions are subject to French law. The competent court in case of dispute will be the one closed to the domicile of the defendant or, upon defendant's sole decision, the place of actual delivery. In the event of a dispute arising from this contractual relationship, the user and Badam TS agree to seek an amicable solution before any legal action.

SHIPPING COSTS AND DELIVERY

Shipping Rates

We apply the current rates of La Poste (managing Colissimo Express service) for France and other countries. Simply add the desired products to your cart and then select the delivery country to know the cost of shipping you will be charged. 

Time delivery

When will your order be actually delivered? The expedition of your order divides in two phases starting when your payment is received:

• First, our teams prepare your order (the time varies from a few hours to 5 working days), your package is then made available to the carrier (La Poste managing the Colissimo Express delivery service for France and abroad).

• In a second phase the Post receives the packaged order and is committed to deliver it within 48 hours for France and less than a week for most other countries (Colissimo Express).

• In the case of an order to be delivered in Paris area, Badam TS may also perform personally the delivery, with your agreement, this service being free.

Product Availability

All products on the website www.badamts.com are available unless otherwise stated, and are dispatched within 5 working days, in other words within five days excluding Saturdays, Sundays and holidays from the date of your order (with payment received), depending on your order (unless otherwise specified: namely, a period which indicates a higher number of working days or a product listed as "Not Available").

What is the tracking number? With the tracking system, your parcel is unique. Using the number on the proof of deposit which will be provided to you by email by Badam TS, you can know at any moment the status of your shipment on the website of Colissimo. Security and reception of packages

Delivery and guarantees

Deliveries are made in France and abroad by Colissimo and its affiliates abroad with with tracking number and delivery of parcels against signature.

Receipt of your package

To avoid any dispute with the carrier, please check the condition of the packaging and the conformity of the product (s) delivered, and issue any reserve if necessary, on the delivery document of the carrier.

What is a notice of passage? It is the document that the mailman leaves in your mailbox telling you that he presented to your home and he could not give you the parcel (you were absent at the time of passage, your mailbox is too small ...). The notice includes the adress of the office where you can collect your parcel from the date indicated on the notice, upon presentation of this document and proof of identity (eg passport or identity card).
